Procedure: How to Change Title of Property

  1. Title on property is the set of rights on the property. A title deed is the piece of document that proves ownership of property. The most important procedure while buying a property is examination of title to verify it is clean.
  2. Title reveals details like ownership of property, any claim on the property (for example due to loan) or legal dues, right of transferability of property and so on. 
  3. Insist on seeing the original title deed and not a copy of it because the original one could have been submitted for a loan. Other documents relating to the property can be found the at sub-registrar's office. When you buy land its title must be changed from the seller to your favour.
  1. Once you get the Sale Deed submit an application to the relevant officer without much gap in time for a title deed. An Encumbrance Certificate (EC) must also be obtained from the Sub Registrar's Office. In some states you can apply for EC online.
  2. Documents to be submitted for title deed include site allotment notice, possession certificate, sale deed, encumbrance certificate, transfer certificate, tax-paid receipts, intermediate sale deeds and registration certificate, to name a few.
  3. The relevant officer conducts site inspection to verify that the property actually exists and the buyer has absolute possession of the property and that the measurement is as per the Sale Deed.
  4. After this a Title Deed is issued with the property owner's name.
  1. Once the title deed has been registered you must approach the local municipal authorities to get the title of the property mutated in your favour. For this you submit the completed application form, affidavit, indemnity bond and a notarized copy of the registered title deed.
  2. After assessing your application the Land and Survey Office decides the value of the property for levying property tax. Then you are issued a letter of mutation of title in your favour.
  3. The process is painfully long and can vary from case to case. It may take 30 - 45 days for the entire procedure.
